Basic Setup Builder distribution permissions and end-user license agreement
END-USER LICENSE AGREEMENT FOR "BASIC SETUP BUILDER 1.0" SOFTWARE
IMPORTANT- READ CAREFULLY. YOU ACCEPT THIS LICENSE AGREEMENT BY SELECTING THE CHECK BOX LABELED "Yes, I agree to the term of this license agreement" THAT IS DISPLAYED BELOW. IF YOU DO NOT AGREE TO THIS LICENSE, CLICK THE BUTTON LABELED "CANCEL" AND THE SOFTWARE WILL NOT BE INSTALLED.
This End-User License Agreement ("EULA") is a legal agreement between you (either an individual person or a single legal entity, who will be referred to in this EULA as "You") and "AMMA Software" for the Software Product that accompanies this EULA (the "Software Product").
If you do not agree to the terms of this EULA, then DO NOT install, access or use the Software Product.
1) LICENSE GRANT
You may try this Software Product during a test period of 30 days. If you decide to use the Software Product after this period you must purchase your Developer License and register it.
A registered copy of the Software Product can be used on a single computer and by a single user. On request a second copy can be registered and used on a mobile computer by the same user and belonging to the same Developer License.
If you are a registered user, you may distribute the output of the Software Product, provided that you shall be solely responsible for any update, support obligation, or other liability that may arise from the distribution.
2) LIMITATIONS
You may not modify, reverse engineer, decompile, or disassemble the Software Product.
Without prejudice to any of "AMMA Software" other rights, "AMMA Software" may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy any and all copies of the Software Product and all of its component parts.
3) COPYRIGHT AND TRADEMARKS.
All title, trademarks and copyrights in and pertaining to the Software Product are owned by "AMMA Software". The Software Product is protected by copyright and trademark laws and international treaty provisions.
You may not remove, modify or alter any "AMMA Software" copyright or trademark notice from any part of the Software Product.
4) LIMITED WARRANTY
a) "AMMA Software" warrants that the Software Product will perform substantially in accordance with the written materials accompanying it for a period of ninety (90) days from the date of delivery.
b) In the event of any breach of warranty or other duty owed by "AMMA Software", "AMMA Software" and its suppliers` entire liability and your exclusive remedy shall be, at "AMMA Software"`s option, either return of the price paid by you for the Software Product (not to exceed the suggested retail price) if any, repair or replacement of the defective Software Product. This Limited Warranty is void if failure of the Software Product has resulted from accident, abuse, or misapplication. Any replacement Software Product will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.
c) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, "AMMA Software" AND ITS SUPPLIERS DISCLAIM ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED. THE LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO STATE/JURISDICTION. Some states and jurisdictions do not allow disclaimers of or limitations on the duration of an implied warranty, so the above limitation may not apply to you. To the extent implied warranties may not be entirely disclaimed but implied warranty limitations are allowed by applicable law, implied warranties on the Software Product, if any, are limited to ninety (90) days.
d) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL "AMMA Software" OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES. IN ANY CASE, "AMMA software"`S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS EULA SHALL BE LIMITED TO THE AMOUNT YOU ACTUALLY PAID TO "AMMA Software" FOR THE SOFTWARE PRODUCT. Because some states and jurisdictions do not allow the exclusion or limitation of liability, the above limitation may not apply to you.
