CachemanXP distribution permissions and end-user license agreement
Users of CachemanXP must accept this disclaimer of warranty:
READ THIS DOCUMENT CAREFULLY BEFORE INSTALLING THIS SOFTWARE. BY DOWNLOADING, INSTALLING AND USING THIS SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL OR USE THE SOFTWARE. YOU AGREE THAT YOUR INSTALLING OR USE OF THE SOFTWARE ACKNOWLEDGES THAT YOU HAVE READ THIS LICENSE, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
This is a legal agreement between you (either an individual or an entity) and Outertech.
COPYRIGHT. The SOFTWARE is protected by United States copyright law and international treaty provisions. You acknowledge that no title to the intellectual property in the SOFTWARE is transferred to you. You further acknowledge that title and full ownership rights to the SOFTWARE will remain the exclusive property of Outertech and you will not acquire any rights to the SOFTWARE except as expressly set forth in this license. You agree that any copies of the SOFTWARE will contain the same proprietary notices which appear on and in the SOFTWARE.
2. Limitations on Using, Copying, and Modifying the Software
Except to the extent expressly permitted by this agreement you must not use, copy or modify the software.
3. Decompiling, Disassembling, or Reverse Engineering
You are NOT permitted to study the source code of this software by ANY way and for ANY reason. You are NOT allowed to modify, decompile, disassemble or make reverse engineering of this software.
4. Software Licenses
CachemanXP has two types of licenses: Workstation and Site. The Workstation license is a one or multi computer license, the amount being selectable at purchase time. The Site License is a multi-computer license that allows usage of the program in the registered mode by all members of the company (team, group, and etc), which owns it. If you decide not to purchase the full version of CachemanXP you are allowed to use the unregistered shareware version for an unlimited time.
5. No Transfer of License
You must not transfer your license of the software except to the extent expressly permitted by this agreement ways. You are NOT permitted to generate registration keys, to sell, to transmit or to distribute them by ANY other way. You are NOT permitted to hand in employment or lease, to sell or transmit to other faces and also by ANY other way to distribute the registered copy of the software. Distribution of the unregistered shareware version is on the contrary welcomed.
6. DISCLAIMER OF WARRANTY
THE SOFTWARE IS PROVIDED AS-IS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. AUTHOR IS NOT OBLIGATED TO PROVIDE ANY UPDATES, UPGRADES OR TECHNICAL SUPPORT FOR THE SOFTWARE. IN NO EVENT AUTHOR WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OR FOR ANY LOST PROFITS, LOST SAVINGS, LOST REVENUES OR LOST DATA ARISING FROM OR RELATING TO THE SOFTWARE OR THIS AGREEMENT, EVEN IF AUTHOR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
CachemanXP is Copyright (c) 2004-2009 by Outertech.
We allow the free distribution of unregistered shareware version of CachemanXP, but we retain ownership and copyright of CachemanXP and its source code in its entirety. You may distribute CachemanXP shareware version only subject to the following conditions:
You are allowed to distribute CachemanXP shareware version through the Internet, BBS's, Shareware distribution libraries, CD-ROMs and Magazine Cover Media. You may charge a distribution fee for the package, but you must not represent in any way that you are selling CachemanXP itself. You have to inform us before any distribution at email@example.com. We will send you information about new CachemanXP releases. CachemanXP shareware version may be bundled and distributed together with other software products.
You may not modify the program or documentation files in any way. You must include all the files that were in the original distribution. You may not decouple or otherwise reduce CachemanXP to a human perceivable form. You may not sell CachemanXP or charge a distribution fee, except to recover the media costs.
