SOFTWARE LICENSE AGREEMENT
PLEASE READ THIS SOFTWARE LICENSE AGREEMENT CAREFULLY BEFORE DOWNLOADING OR USING THE SOFTWARE.
USAGE & LICENSE GRANT
PhotonFX Software ("PhotonFX") grants you a non-exclusive license to test this software in Tryout version, and any associated documentation ("The Tryout"), as indicated herein.
You MAY: (a) install and use the Tryout for evaluation purpose only during 30 days after the installation; (b) create icons using the Tryout and save them for evaluation purpose only; (c) Redistribute the Tryout by any mean (CDROM, Cover Disc, Web site...) as long as you do change the original package and distribute only the original install package
You may NOT lease, rent, sell, or make any profit out of the Software. You may NOT copy and/or distribute this software to others. The Software may NOT be circulated in any incomplete or modified form, which means you may not alter, delete, or add any files
in the distribution package. Reverse engineer, Decompile, Disassemble, Modify, Translate, make any attempt to discover the source code of the Software, or create derivative works from the Software are prohibited!
RESTRICTIONS
You MAY NOT: (a) use the Tryout after the evaluation period of 30 days; (b) use the icons created with the Tryout (except for test purpose or if you purchased the full version); (c) sell this Tryout package (except for shipment and handling charges); (d) cause or permit reverse engineering, disassembly, decompilation or alteration of this Tryout; (e) remove any product identification, copyright notices, or other notices or proprietary restrictions from this Tryout; (f) copy the documentation accompanying the software.
TERM
This License is effective until terminated. You may terminate it at any time by destroying the Tryout , together with all copies thereof. This License will also terminate if you fail to comply with any term or condition of this Agreement. Upon such termination, you agree to destroy the Tryout, together with all copies thereof.
COPYRIGHT/OWNERSHIP
This Tryout and its source code are proprietary products of PhotonFX and are protected by copyright and other intellectual property laws. The Tryout is licensed and not sold. You acquire only the right to use the Tryout and do not acquire any rights, express or implied, in the Tryout other than those specified in this License.
DISCLAIMER OF WARRANTIES
The Tryout is supplied "AS IS". PhotonFX disclaims all warranties, expressed or implied, including, without limitation, the warranties of merchantability and of fitness for any purpose. The user must assume the entire risk of using the Tryout.
DISCLAIMER OF DAMAGES
PhotonFX assumes no liability for damages, direct or consequential, which may result from the use of the Tryout , even if PhotonFX has been advised of the possibility of such damages. Any liability of the seller will be limited to refund the purchase price.
