Verbal Vanquish distribution permissions and end-user license agreement
This demo version of Verbal Vanquish is copyrighted. You may freely use and distribute the software as long as you make no changes to the text, language, or code without permission of English Plus.
THIS SOFTWARE AND MANUAL ARE PROVIDED FOR EVALUATION ONLY, ON AN "AS IS" BASIS. THE AUTHOR DISCLAIMS ALL WARRANTIES RELATING TO THIS SOFTWARE, WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. This agreement shall be governed by the laws of the State of Connecticut and shall inure to the benefit of the author and any successors, administrators, heirs and assigns. Any action or proceeding brought by either party against the other arising out of or related to this agreement shall be brought only in a STATE or FEDERAL COURT of competent jurisdiction located in New Haven County, Connecticut. The parties hereby consent to in personam jurisdiction of said courts.
You may not use, copy, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the licensed program except as provided in this agreement. Any such unauthorized use shall result in immediate and automatic termination of this license. All rights not expressly granted here are reserved to the author.
We have a simple distribution policy: You have permission to
distribute our shareware in its original, unaltered form as long as you
1) Identify it as shareware (with an appropriate definition)
2) Leave all intellectual property and copyright notices in place
....and as long as we do not request you to stop.
You may archive our programs, unarchive them, include/exclude optional files
(like this XML file), include them with other programs on the same
diskette, and do essentially anything you want as long as you respect the
integrity of the program and all copyright laws, even if you may not be
subject to them. We want the widest possible distribution, and we do not
want to stand in your way so long as you are honest with our mutual customer.
You may post the .EXE installation file by itself rather than in the .ZIP package.
If you are distributing in vending rack or point-of-purchase sales, please
request our permission. This is the only area which it seems that customers
do not understand shareware. ASP, ESC, Walnut Creek, Simtel, Garbo, Winsite,
SICS, PC-SIG, Washington State, STAR, Way Cool, Bongo, EMS, APCUG, PC-related
periodical, and Night Owl collections are pre-authorized to include our
programs on CD-ROM.
This is our normal distribution sequence:
1. New versions are offered to our registered users and distributed to all
users who have registered within a year of the release date.
2. New versions are posted on our web site download page, currently at
3. All ESC distribution members are included in the regular ESC CD-ROM.
This saves us both time and money. If you work a lot with educational
materials, consider joining the ESC (Educational Software Cooperative).
We also work with the current ASP and Share-It distribution, if any.
